Frequently Asked Questions about Our Terms of Service (and other legal stuff)
Who owns the copyright of photos taken with your service?
Copyright always resides with the originator of the work (with some exceptions) -- which means all images/photos generated automatically belong to our company. However, we have a very liberal usage license which allows copying, editing, distribution for private (non-commercial) use. Copyright maybe transferred for a standard fee -- please refer to our price list for details.
Can I make my own prints or give copies to my friends and family?
Absolutely! Our terms of service provides a very liberal non-commercial license. That means, for the most part, you can do anything you want with the images/photos as long as it is non-commercial in nature. That means you can edit, modify, copy, distribute, and print any and all images we created on your behalf.
Are your photographers insured?
Most of our photographers are not insured beyond standard property loss/theft. Professional photographers normally carry "Errors and Omissions" (E&O) Insurance which is a type of "mal-practice" insurance that protects the photographer in the event the he/she is unable to fulfill their duties. Since our photographers are not full-time professionals, they often do not carry such insurance. This risk is transferred to the client hiring our services.
What happens if a client is not happy with the services rendered?
Since we do not carry Errors & Omissions Insurance, we offer a full or partial refund (depending on the circumstances) if services are not done to our client's satisfaction. We cannot offer refunds on digital products (DVDs/CDs) once the client has accepted them. Client assumes some risk since they are knowingly hiring amateurs (although quite skilled).
How much of a refund do you offer?
If no images/photos where given to the client, then we offer a 100% refund. If the client has accepted the photos in any form (including online), we are only able provide a 50% refund for the "time based" services (packages, hourly rates, etc. No refund is possible on products (CD/DVD/prints). Our refund policy is intended to help reduce the risk involved in using non-professional services.
